Terms & Conditions
Liability:
Whilst every effort will be made to meet our delivery dates, we accept no responsibility for any costs or losses of income sustained by any client due to production delays or any printing or delivery undertaken by Chapter One Promotions for whatever reason.
Cancellation:
Any order cancelled will incur a charge for the work which we have already carried out on your behalf.
Artwork:
Whilst every care is taken with your originals we take no responsibility for loss or damage.
Templates:
We accept no responsibility or liability for the accuracy or content of templates which we supply.
Copyright:
The customer warrants that all necessary permission to reproduce the artwork/photographs/written material has been obtained and indemnifies Chapter One Promotions from any action arising. The copyright of any written material produced by the author remains with the author.
Chapter One Promotions shall have the right to edit work for the original printing and for any reprinting of the anthology provided the meaning of the text is not materially altered, and shall have the right to publish and promote the work in suitable style as to paper, printing, binding, cover and /or jacket design, and to fix or alter title and price.
Full Colour Printing:
All reasonable efforts shall be made to obtain the best possible colour reproduction on customer’s work but variation is inherent in the print process and it is understood and accepted as reasonable that, Chapter One Promotions shall not be required to guarantee an exact match in colour or texture between the customer’s photograph, transparency, proof, electronic graphic file, previously printed matter (whether printed by Chapter One Promotions or other party) or any other materials supplied by the customer and the printed article the subject of the customer’s order.
Quotations:
Quotations are valid for 30 days unless otherwise stated.
Payment:
Payment terms for Chapter One Promotions services is in full. For some selected services payment is on receipt of order. Payment terms can be agreed as to be paid in full or broken down in instalments: half upon order and half upon delivery. Work will commence once half or full payment has been received. Payment can be made either by cheque payable to Chapter One Promotions or direct online using the appropriate links.
Invoices for annual services will be sent one month prior to payment due date to be settled within 30 days. If payment is not received and paid in full within 30 days then the service will be severed with immediate effect.
Credit Terms and Payment:
For invoices not settled within the agreed credit terms or for payments returned unpaid (such as cheques, credit cards or similar), Chapter One Promotions reserves the right to charge interest on the overdue debt at 2% above the HSBC base rate at the time and an administration fee to cover its debt recovery costs and any other costs relating to the collection of payment.
Insolvency:
If the customer ceases to pay its debts in the ordinary course of business or cannot pay its debts as they become due or being a company is deemed to be unable to pay its debts or has a winding-up petition issued against it or being a person commits an act of bankruptcy or has a bankruptcy petition issued against it Chapter One Promotions without prejudice to other remedies shall (i) have the right not to proceed further with the contract or any other work for the customer and be entitled to charge for work already carried out (whether completed or not) and materials purchased for the customer, such charge to be an immediate debt due to Chapter One Promotions, and (ii) in respect of all unpaid debts due from the customer have a general lien on all goods and property in Chapter One Promotions possession (whether worked on or not) and shall be entitled on the expiration of 14 days’ notice to dispose of such goods or property in such manner and at such price as Chapter One Promotions thinks fit and to apply the proceeds towards such debts.
Data Protection:
By placing an order, or an enquiry with Chapter One Promotions, the customer consents to its details being passed on for accounting and marketing purposes only. The details will be kept even after the customer’s trading relationship with Chapter One Promotions has terminated. Chapter One Promotions may use the customer’s personal data to let customers know about goods and services similar to the goods or services provided, or enquired into, to the customer previously and any other matters that Chapter One Promotions consider may be of interest.
Variation to Terms and Conditions:
These terms and conditions may be amended from time to time.
Law:
These terms and conditions and all other express terms of the contract with customers shall be governed and construed in accordance with English law. English Courts shall have jurisdiction in relation to any matters arising in connection with any contract between the Chapter One Promotions and the customer into which these terms are incorporated.
